Can a mobile phone contract be cancelled early if you are in an IVA?

IVA was set up in Oct last year but want to come out of mobile phone contract (due to run until July time). Can it be cancelled if I say I can not afford it?Can a mobile phone contract be cancelled early if you are in an IVA?If you are in an IVA then i would ask the person who deals with it to contact them. To be honest I think they could cancel your contract because you have a credit check before you take out your contract, they like everybody else such as, your credit card company, bank, mortgage provider and loan would be whats known a your creditors. Mobile phone contracts shouldnt be any different. You might be better declaring yourself bankrupt, doing this would wipe all your debts. But you could lose your house if it is mortgaged, or own outright.Can a mobile phone contract be cancelled early if you are in an IVA?When your IVA was set up the cost of your phone contract should have been included in your income and expenditure (the analysis of whats left when you have paid your essentials) so technically you should be able to afford it. However, if in reality you can't for whatever reason you need to solve the problem now.



If you cancel the contract now the phone company will pursue you for the balance with all the problems that entails for you and them i.e. cost on their part CCJ on yours added to that when your insolvency practitioner realises that you have 拢x extra each month because you are no longer paying your phone bill he is likely to increase your IVA contributions by a similar amount the result being that you are no better off.



In my opinion the best option would be to tell your insolvency practitioner that you can no longer afford the phone and ask him to include the phone provider in your IVA as an additional creditor which is then paid out of your monthly contributions. You can then ask him to allow you to keep some of the contract money to pay for a "pay as you go" phone but offer the balance towards your IVA contributions.



By doing this you avoid a fight with the phone provider, because they have to accept the terms of the IVA and you also avoid a separate CCJ because the debt is covered by the IVA.
