Can I get out of my mobile phone contract if my phone has a manufacturers fault?

I have had my Samsung E840 for 2 months now. The handset slides up and down. I was using my phone and the piece of handset that slides up became detached from the phone so now it is in two pieces!! I did not use force or drop my phone and so think it is a manufacturers fault. I have been into my local orange shop and they said that if they send the phone away I will be charged as it looks like a fault due to negligence and being rough with my phone. This is definately not what has happened and I refuse to pay for it to be fixed because it wasn't my fault. I want to terminate my contract as they will not provide a new mobile phone for me. Unfortunately I do not have insurance for my phone but it should still be covered under the manufacturers warranty. No one seems to be able to help am I in the right here or by law should |I have to pay for my mobile. Not a chance in hell of getting out of the contract. You have about 14 days after you 1st take out the contract to cancel after that you are stuck with them.

The contracts are written carefully so you can't get out. The phone was probably "free" so they will only give you something to that value. 2 possibilities; do you have household contents cover with portable gadgets included? or you could go to one of the small dealers that trade in some shopping centres and buy a second hand unlocked phone and put your sim in it. You could try sending it back to Samsung suggesting it was faulty from day one, but don't have too much hope.
